TERMS & CONDITIONS

Effective Date: October 7th 2026
Last Updated:

These Terms & Conditions (“Terms”) govern the marie-siles website, community programs, research initiatives, surveys, product-development activities and related communications.

marie-siles is a beauty and skincare brand operated by Steven Myrthil Beauty Inc. (“Marie-Siles,” “we,” “us,” or “our”).

marie-siles currently conducts its activities for people located in Canada and France.

By accessing our website or participating in a marie-siles initiative, you agree to these Terms. Where applicable, our Privacy Policy and any separate consent, photo release, collaboration agreement or other agreement presented to you will also apply.

1. OUR PURPOSE

marie-siles believes beauty products should be developed with a meaningful understanding of the people who may use them.

We therefore want to create an ongoing relationship with our community rather than simply communicate products to customers after they have already been developed.

We may invite members of our community to tell us about their skin, beauty routines, experiences, concerns, preferences, product expectations, desired textures, shades, ingredients, packaging preferences and other information that can help Marie-Siles understand real consumer needs.

We may also invite people to voluntarily submit photographs of their skin.

The information we collect through these initiatives may be used to conduct consumer and market research, understand consumer needs in Canada and France, identify product opportunities, guide product development and improvement, evaluate concepts and better understand how marie-siles can serve its communities.

Participation in these activities is voluntary.

2. INFORMATION YOU MAY CHOOSE TO PROVIDE

Depending on the marie-siles program or form you use, we may ask you to provide information such as:

  • your name or preferred name;

  • email address;

  • country or general geographic location;

  • age or age range, where appropriate;

  • skin type and appearance;

  • skin concerns;

  • skincare and makeup routines;

  • product experiences and preferences;

  • products or ingredients you use;

  • beauty needs and expectations;

  • survey and questionnaire responses;

  • photographs that you voluntarily submit;

  • testimonials, comments, ideas and feedback; and

  • communications you send to Marie-Siles.

The particular information requested and the purposes for which it will be used will be explained through the applicable form, consent notice, Privacy Policy or other notice where required.

Please do not provide information that we have not requested, medical records, or personal information about another person.

3. WHY WE COLLECT COMMUNITY INFORMATION

Subject to applicable law and the consent or other lawful basis applicable to the activity, information provided to Marie-Siles may be used to:

Understand our community.
We may analyze feedback to understand the skincare, makeup and beauty preferences of consumers in Canada and France.

Conduct consumer and market research.
We may analyze responses individually or together with responses from other participants to identify trends, preferences and unmet consumer needs.

Develop products.
Community information may inform research, product concepts, formulations, shades, textures, packaging, positioning and other aspects of future Marie-Siles products.

Improve products and experiences.
Feedback may help us understand what people like, dislike or want changed.

Communicate with participants.
We may contact you about a submission, research initiative, collaboration or other interaction you initiated.

Develop our community.
Where you separately choose to receive these communications, we may communicate marie-siles news, product development, launches, invitations, opportunities and other brand information.

Our goal is to use community information in a manner consistent with applicable privacy, consumer-protection, electronic-marketing and other requirements that apply to our activities in Canada and France.

4. SKIN PHOTOGRAPHS

marie-siles may invite members of its community to voluntarily submit photographs showing their skin.

These photographs may help Marie-Siles understand how skin actually appears across our community and may contribute to our research into consumer needs and future products.

Submitting a photograph for research does not automatically authorize marie-siles to publish the photograph or use it in advertising.

Where a photograph is submitted for research or product-development purposes, marie-siles will use it only for the purposes described when the photograph is collected and other purposes permitted by applicable law.

Where required, additional consent will be requested before materially different uses are made.

5. ADVERTISING AND PUBLIC USE OF PHOTOGRAPHS

marie-siles may occasionally identify a photograph, testimonial, story, video or other contribution that we would like to feature publicly.

This may include use on:

  • the marie-siles website;

  • marie-siles social-media accounts;

  • digital advertising;

  • online campaigns;

  • email campaigns;

  • promotional materials;

  • product-development stories;

  • presentations;

  • press or public-relations materials; or

  • other agreed marie-siles brand communications.

Research consent is not advertising consent.

Before using an identifiable participant's photograph for advertising or other public promotional purposes, Marie-Siles will obtain the participant's appropriate permission or enter into a separate photo release, licence, collaboration or other agreement where required.

The separate agreement or consent may specify:

  • which photograph or content marie-siles may use;

  • where it may appear;

  • the permitted purposes;

  • permitted editing, cropping or formatting;

  • whether the participant's name or other identifying information may appear;

  • the territories in which it may be used;

  • how long the permission lasts;

  • whether the use is exclusive or non-exclusive;

  • any right to withdraw consent where legally applicable; and

  • whether compensation is provided.

marie-siles will not treat participation in consumer research as automatic permission to become the public face of a campaign.

6. PAID PHOTO AND CONTENT COLLABORATIONS

In some circumstances, marie-siles may offer to pay a participant for permission to use a photograph, video, testimonial or other contribution in advertising or brand communications.

Any payment, fee, product compensation, royalty or other consideration will be determined separately between marie-siles and the participant.

Where compensation is offered, the applicable photo release, licence or collaboration agreement should specify the compensation and the permitted use of the content.

Payment for one agreed use does not automatically give marie-siles unlimited rights to every photograph or piece of content created by that participant.

Similarly, participation in marie-siles research does not guarantee that marie-siles will purchase, license or publicly use a participant's photographs.

marie-siles and a participant may also agree to an unpaid promotional use where legally permitted and where the participant knowingly and voluntarily gives the appropriate permission.

7. OWNERSHIP OF PARTICIPANT PHOTOGRAPHS

Unless a separate written agreement expressly provides otherwise, submitting a photograph to Marie-Siles does not by itself transfer ownership of that photograph to Marie-Siles.

Instead, marie-siles receives only the permissions necessary for the purposes to which the participant has agreed or that are otherwise permitted by applicable law.

If marie-siles wants broader commercial rights to a photograph, those rights may be addressed through a separate written licence, release or collaboration agreement.

8. WITHDRAWAL OF CONSENT

Where marie-siles relies on consent to process personal information, participants may withdraw that consent subject to applicable law and contractual limitations.

Requests may be sent to:

lets.try@marie-siles.com

Withdrawal generally applies to future processing and does not necessarily invalidate processing that lawfully occurred before consent was withdrawn.

A withdrawal may also be subject to applicable legal or contractual rules where, for example, content has been licensed under a separate agreement or incorporated into materials that cannot reasonably or legally be recalled.

The applicable Privacy Policy or separate agreement will provide additional information where relevant.

9. COMMUNITY FEEDBACK AND PRODUCT DEVELOPMENT

marie-siles welcomes suggestions and honest feedback.

Participants may tell us what they want from skincare and makeup products and what they believe is missing from the market.

However, many people may independently suggest similar ideas.

Unless Marie-Siles expressly enters into a separate written agreement with you, providing general feedback, ideas or suggestions does not create ownership rights in a future Marie-Siles formula, product, packaging, marketing concept or business decision merely because the resulting product incorporates or resembles that feedback.

This provision does not transfer ownership of your personal information or photographs.

Formal creative collaborations, commissioned work, photography, influencer partnerships or other commercial collaborations may be governed by separate agreements.

10. EMAIL AND COMMUNITY COMMUNICATIONS

Providing an email address for research, customer service or submitting a photograph does not by itself mean that you have agreed to receive every type of marie-siles marketing communication.

Where required, marie-siles will obtain appropriate consent before sending marketing communications.

Marketing consent should be presented separately from participation in skin research or photo submission.

Recipients may unsubscribe from marketing communications through the unsubscribe mechanism provided in the communication or by contacting:

lets.try@marie-siles.com

We may still respond to communications you initiate or send necessary non-promotional communications concerning a submission, request, collaboration or transaction where permitted.

11. PRIVACY — CANADA AND FRANCE

Because marie-siles currently focuses on Canada and France, we intend to structure our personal-information practices with the applicable privacy requirements of those markets in mind.

Depending on the individual and activity, this may include applicable Canadian federal and provincial privacy requirements, including Québec privacy requirements where applicable, and European Union and French data-protection requirements, including the General Data Protection Regulation (“GDPR”) where applicable.

Our Privacy Policy should explain, as applicable:

  • who is responsible for processing personal information;

  • what information is collected;

  • why it is collected;

  • the applicable purposes and legal bases;

  • who may receive it;

  • service providers involved in processing;

  • where information may be processed;

  • applicable international transfers;

  • retention periods or criteria;

  • security measures;

  • applicable access, correction, deletion, objection, restriction, portability or withdrawal rights;

  • how to exercise privacy rights; and

  • how to contact the appropriate privacy authority where applicable.

Where separate consent is legally required, acceptance of these Terms will not be used as a substitute for that consent.

12. MARKETING CONSENT IS SEPARATE

Agreeing to these Terms does not, by itself, constitute consent to receive promotional emails where separate consent is required.

Similarly, agreeing to receive marketing emails does not constitute permission for Marie-Siles to publish a participant's photograph.

Where appropriate, marie-siles will provide separate choices for:

  1. participating in research and providing skin information;

  2. submitting skin photographs for research;

  3. receiving marketing and community communications; and

  4. authorizing public or advertising use of photographs or testimonials.

13. SKINCARE INFORMATION IS NOT MEDICAL ADVICE

marie-siles is a skincare, makeup and beauty brand.

Our surveys, communications, research, product information and community discussions are not intended to diagnose, treat, cure or prevent disease and are not a substitute for professional medical or dermatological advice.

Participants should not send medical records or information that has not been requested.

If you have a medical concern, skin disease, severe reaction or other health concern, consult an appropriately qualified healthcare professional.

14. MINORS

marie-siles does not knowingly invite children to independently provide skin photographs or participate in programs requiring personal information where doing so would be inconsistent with applicable law.

Specific programs may establish age requirements and may require parental or legal-guardian authorization where appropriate.

If you believe a minor has provided information or photographs contrary to our requirements, contact:

lets.try@marie-siles.com

15. INTELLECTUAL PROPERTY

The marie-siles brand, name, logos, website materials, original graphics, written content, product branding and other intellectual property belong to Steven Myrthil Beauty Inc. or are used under appropriate authorization, except where otherwise indicated.

Nothing in these Terms transfers ownership of marie-siles intellectual property.

Likewise, nothing in these Terms automatically transfers ownership of a participant's photographs or original content to Marie-Siles.

16. THIRD-PARTY SERVICE PROVIDERS

marie-siles may use appropriately selected service providers for website hosting, forms, email communications, data storage, analytics, customer communications and other operational functions.

Our Privacy Policy will provide information concerning relevant categories of recipients and international processing or transfers where required.

17. FUTURE PRODUCTS AND RESEARCH

Participation in research does not guarantee that Marie-Siles will create, manufacture or launch a particular product.

Research concepts, formulations, prototypes, packaging, proposed products and launch plans may change or be discontinued.

Information provided by participants may form one of many sources Marie-Siles considers when making product and business decisions.

18. NO EMPLOYMENT OR PARTNERSHIP

Participation in a survey, research initiative or community activity does not create employment, agency, partnership or joint-venture status between a participant and Marie-Siles or Steven Myrthil Beauty Inc.

A paid photography, content-creation, influencer or other commercial collaboration may be governed by a separate agreement.

19. CHANGES TO THESE TERMS

marie-siles may revise these Terms as our activities, website, programs or applicable requirements evolve.

The current version will be posted with its effective or last-updated date.

Where applicable law requires additional notice or renewed consent for a particular change, we will provide it.

20. MANDATORY CONSUMER AND PRIVACY RIGHTS

Nothing in these Terms is intended to exclude, waive or restrict a consumer, privacy or other statutory right that cannot lawfully be excluded, waived or restricted.

If a provision of these Terms conflicts with a mandatory legal requirement applicable to an individual, the mandatory requirement will prevail to the extent of that conflict.
